為保障人民自由權利，就其限制除依憲法第23 條應符法律保留、比例原則外，晚
近司法院大法官解釋更強調應踐行「正當法律程序」與「正當行政程序」，請分別
回答下列：
㈠正當法律程序內容有那些？試扼要說明之；（10 分）
㈡大法官解釋中針對「司法審理程序」強調「正當法律程序」有那些解釋？試舉二
例並說明之；（8 分）
㈢大法官解釋中針對「行政程序」強調「正當行政程序」有那些解釋？試舉二例並

第 2 題
司法獨立即審判獨立，為了確保法官審判獨立，憲法本文，增修條文與司法院大法
官解釋曾分別從法官的身分（8 分），法官的職務（8 分），與法院（司法）的預
算（8 分）等角度予以制度性設計與解釋，試分別說明之。

第 3 題

South-East Asia’s low-cost airlines have gone from feast to famine. In just ten years, low-
cost carriers’ share of the region’s aviation market has soared from almost nothing to 58%.
The rise of low-cost carriers reflects the demand for flying in an increasingly well-off part
of the world. However, the expansion of airlines’ capacity seems to be getting ahead of the

韓國昨日表示，正密切監控首爾東部一家醫院，擔憂恐有數百人可能已經暴露在中
東呼吸症候群（MERS）之下。一位70 歲婦女在探望另一家醫院裡受感染的親戚時
感染到MERS，並且恐怕已經將病毒傳播到新的地區。官員說，因為新區域可能會
有新的病例發生，所以MERS 的爆發是否會減弱現在仍言之尚早。（10 分）

Millions of people will go hungry due to climate change. Food production worldwide
reduces by 2 per cent per decade, according to the latest scientific report. Climate change
has become the biggest threat to our chances of winning the fight against hunger.
