§ 425 — Prohibition on circumventing access control measure
425.—(1) Subject to the provisions of this Division, a person infringes this section if the person circumvents an access control measure.(2) For the purposes of this Division, a person circumvents an access control measure if —(a)
the access control measure is applied —(i)
to a protected copy;
(ii)
by or with the authority of the rights owner of the protected copy; and
(iii)
in connection with the exercise of the copyright or any right in the performance, as the case may be;
(b)
the person does any act that the person knows or ought reasonably to know circumvents the access control measure; and
(c)
the act is done without the rights owner’s authority.
—(1) Subject to the provisions of this Division, a person infringes this section if the person circumvents an access control measure.
(2) For the purposes of this Division, a person circumvents an access control measure if —(a)
the access control measure is applied —(i)
to a protected copy;
(ii)
by or with the authority of the rights owner of the protected copy; and
(iii)
in connection with the exercise of the copyright or any right in the performance, as the case may be;
(b)
the person does any act that the person knows or ought reasonably to know circumvents the access control measure; and
(c)
the act is done without the rights owner’s authority.
