§ 41 — Outstanding fees, penalties, etc.

41.—(1) If —(a)

any fee imposed under section 31 in respect of a licence is not paid in full by the due date for payment; or

(b)

any financial penalty imposed under section 39(1)(ii) in respect of a licensee is not paid in full by the due date for payment,

interest at the prescribed rate is payable by the licensee concerned on the outstanding amount of any such fee or financial penalty.

(2) The LTA may recover as a debt in a court of competent jurisdiction any of the following amounts that has become due and payable but has not been paid:(a)

any fee imposed under section 31 in respect of a licence;

(b)

any financial penalty imposed under section 39(1)(ii);

(c)

any interest imposed under subsection (1),

and the liability of the licensee concerned to pay is not affected by its licence ceasing (for any reason) to be in force.

—(1) If —(a)
