§ 44 — Saving and transitional provisions for registered qualified individuals

44.—(1) Despite anything in this Act, a person who, immediately before the section 10 commencement date, was an ACRA RQI under section 32 of the ACRA Act as in force immediately before that date (called in this section the old section 32) is, on or after that date, treated as registered under section 10 as a registered qualified individual until the expiry of the period of his or her registration as an ACRA RQI.(2) For the purposes of subsection (1), where the registration of the person as an ACRA RQI under the old section 32 is subject to any terms and conditions, then the deemed registration of the person as a registered qualified individual is subject to the same terms and conditions as if those terms and conditions were imposed under section 10(3).

(3) Where —(a)

an application is made by an individual for registration as an ACRA RQI before the section 36 commencement date; and

(b)

the application is pending immediately before that date,

the application is treated, on or after that date, as an application made by the individual to the Registrar under section 10 for registration as a registered qualified individual.

(3) Where —(a)

an application is made by an individual for registration as an ACRA RQI before the section 36 commencement date; and

the application is pending immediately before that date,

the application is treated, on or after that date, as an application made by the individual to the Registrar under section 10 for registration as a registered qualified individual.
