§ 16 — Defences

16. In any proceedings for an offence under section 15(1), it is a defence for the person charged to prove that —(a)

the person —(i)

is a person whose business is to publish or arrange for the publication of advertisements and that the person received the advertisement for publication in the ordinary course of business; and

(ii)

did not know and had no reason to suspect that the advertisement would contravene the provisions of section 15(1); or

(b)

the advertisement is published for the sole purpose of destroying or exporting the non‑approved EV charger.
