Section 60 — Interpretation of this Part

In this Part —“approved electrical load”, in relation to a development, means the maximum electrical load rating of the development as approved by a market support services licensee under the Electricity Act 2001; “building” includes part of a building; “building works” means —

(a)the erection or extension of a building; or

(b)the alteration, addition or repair of a building, but excludes building works for a temporary building or the occupation of any temporary building; “developer”, for any building works to which this Part applies, means the person for whom or on whose behalf those building works are carried out; “development” means any land or premises on which any development (within the meaning of section 3 of the Planning Act 1998) is or is to be carried out, and in respect of which —

(a)a permission is granted by a competent authority under Part 3 of the Planning Act 1998 on or after the date of commencement of this Part; or

(b)an authorisation by notification under section 21(6) of the Planning Act 1998 is made on or after the date of commencement of this Part; “electrical work” has the meaning given by section 2(1) of the Electricity Act 2001; “gross floor area” means the floor area that is used in the computation of the land betterment charge in relation to any development under the Land Betterment Charge Act 2021; “market support services licensee” has the meaning given by section 2(1) of the Electricity Act 2001; “motor car” means a motor vehicle with 4 wheels which is constructed to carry a load or passengers and the weight of which unladen —

(a)does not exceed 3,000 kilograms in the case of a vehicle which is —

(i)constructed solely for the carriage of passengers and their effects; and

(ii)adapted to carry not more than 7 passengers exclusive of the driver; and

(b)in any other case, does not exceed 2,500 kilograms; “parking lot” means an area within a parking place which is marked out for parking of a single motor car or motorcycle in that area; “parking place” has the meaning given by section 2 of the Parking Places Act 1974; “public authority” extends to include a Town Council.
