§ 140 — Saving and transitional provisions

140.—(1) The Second Schedule has effect.(2) Except as otherwise expressly provided in the Second Schedule, where any period of time specified in any former provision is current immediately before the date of commencement for the repeal of the former provision, this Act has effect as if the corresponding provision in this Act had been in force when the period began to run; and any period of time so specified and current is deemed for the purposes of this Act —(a)

to run from the date or event from which it was running immediately before that day; and

(b)

to expire (subject to any provision of this Act for its extension) whenever it would have expired if this Act had not been enacted.

(3) For a period of 2 years after the date of commencement of this section, the Minister may, by order in the Gazette, amend the Second Schedule by prescribing such additional provisions of a saving or transitional nature consequent on the enactment of this section as the Minister may consider necessary or expedient.

(4) Nothing in this section or the Second Schedule affects section 16 of the Interpretation Act 1965.

(5) In this section, “former provision” means any provision in an Act repealed under section 137(3) or 139.
