§ 79 — Directions in lieu of or in addition to contravention notices

79.—(1) In lieu of or in addition to giving a platform operator a contravention notice under section 77(1)(c), an authorised officer may —(a)

issue any directions to the platform operator that the authorised officer thinks appropriate to bring the civil contravention to an end; and

(b)

where necessary, require the platform operator to take such action as is specified in the direction to remedy, mitigate or eliminate any effects of the civil contravention and to prevent the recurrence of the civil contravention.

(2) A platform operator that, without reasonable excuse, fails to comply with a direction given to the platform operator under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.
