§ 23H — Communication and recording of charge

23H.—(1) A registered retailer must —(a)

inform the registered retailer’s customers of the charge imposed for the provision of each disposable carrier bag, in the manner prescribed; and

(b)

where a receipt is given to a customer, set out the charge mentioned in paragraph (a) as a separate item in the receipt.

(2) A registered retailer who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 3 months or to both.

(3) In a prosecution for an offence under subsection (2), it is not necessary for the prosecution to prove that the defendant intended to commit the offence.

(4) The offence under subsection (2) is a strict liability offence.[Act 14 of 2023 wef 26/05/2023]
