Section 72 — Confirmation of transfers

(1)If any dispute arises —

(a)as to whether an asset or a liability, or a record, is transferred under section 68 or 71; or

(b)as to whether any, or part of any, contract or document relates to an asset or a liability, or a record, transferred under section 68 or 71, the Finance Minister may determine the matter and must provide the concerned parties with written notice of that determination.

(2)The Finance Minister’s determination under subsection (1) is final and binding on the transferor concerned and the Agency.
