(如被請求方的主管當局不能在接獲請求後90日內，取得和提供該等資料，包括在提供該等資料方面遇上障礙，或拒絕提供該等資料)被請求方的主管當局須立即通知申請方，解釋不能提供資料的理由、障礙的性質或拒絕的理由。
