Section 22FQ — Duty to carry out energy efficiency improvement plan

(1)Subject to subsection (2), the owner of the Type 1 building must, within the prescribed period or any longer period that the Commissioner of Building Control may allow in writing —

(a)ensure that the measures set out in the energy efficiency improvement plan are carried out; and

(b)submit all of the following to the Commissioner of Building Control:

(i)a certificate of completion relating to the measures in the energy efficiency improvement plan certifying that —(A) the measures have been carried out and completed; and (B) the specified reduction or approved reduction in energy use intensity for the Type 1 building has been achieved;

(ii)any other document relating to the Type 1 building or the energy efficiency improvement plan that the Commissioner of Building Control may require.

(2)To avoid doubt, if —

(a)the Type 1 building concerned is also a Type 2 building; and

(b)the energy efficiency improvement plan involves a major energy use change to the building, the major energy use change must be carried out in accordance with Division 5.

(3)The certificate of completion mentioned in subsection (1)(b)(i) must —

(a)be prepared and signed by a specified individual; and

(b)be submitted in the form and manner specified by the Commissioner of Building Control.

(4)An owner of a Type 1 building who, without reasonable excuse, contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $150,000 and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part of a day during which the offence continues after conviction.[Act 28 of 2024 wef 30/09/2025]
