§ 114 — Rebuttable presumption of paternity

114.—(1) Where any person was born —(a)

during the continuance of a valid marriage between his or her mother and any man; or

(b)

within 280 days after the dissolution of the marriage, the mother remaining unmarried,

it is presumed that the person is the legitimate child of that man, unless the contrary is proved.

(2) Subsection (1) does not apply to a person whose parenthood is determined under the Status of Children (Assisted Reproduction Technology) Act 2013.[16/2013]
