§ 109 — Application for pre-market approval

109. Without limiting section 292(4), the Agency may refuse to consider an application for pre‑market approval with respect to a novel food or a genetically modified food if the application does not contain sufficient information for the Agency to make an assessment as to the public health and safety considerations as described in section 105.
