§ 301 — Surrender of FSSA authorisation

301.—(1) This section applies where an FSSA authorisation is revoked or cancelled, or expires and is not renewed.(2) The Agency may, in any of the circumstances described in subsection (1), direct the former holder of an FSSA authorisation —(a)

to surrender or return to the Agency, within a period stated in the direction, the revoked, cancelled or expired FSSA authorisation; or

(b)

in the case of an FSSA authorisation granted in digital form, to remove, within a period stated in the direction, the digital FSSA authorisation from each mobile communication device or other electronic device on which the digital FSSA authorisation is capable of being displayed.

(3) A person who, without reasonable excuse, fails to comply with a direction given to the person under subsection (2) shall be guilty of an offence and shall be liable on conviction —(a)

where the person is an individual — to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 3 months or to both; or

(b)

where the person is not an individual — to a fine not exceeding $10,000.

(4) Any direction under this section to return or surrender an FSSA authorisation does not extend to any mobile communication device or other electronic device on which an FSSA authorisation granted in digital form is displayed.
