§ 12 — Unauthorised manufacture, etc., of guns, etc.

12.—(1) A person commits an offence if —(a)

the person manufactures or takes part in the manufacture of, or disposes of, any object or thing;

(b)

the object or thing is a gun, a major part of a gun, or a gun accessory;

(c)

the person knows that or is reckless as to whether the object or thing is a gun, a major part of a gun, or a gun accessory; and

(d)

the person is not one of the following:(i)

a person granted a licence to manufacture or dispose (as the case may be) the gun, major part of a gun or gun accessory;

(ii)

a class licensee authorised under a class licence to manufacture or dispose (as the case may be) the gun, major part of a gun or gun accessory;

(iii)

a person exempt from this section under section 87, 88 or 89 in relation to the manufacture or disposal of (as the case may be) the gun, major part of a gun or gun accessory.

(2) A person commits an offence if —(a)

the person repairs or takes part in the repair of any object or thing;

(b)

the object or thing is a gun or a gun accessory;

(c)

the person knows that or is reckless as to whether the object or thing is a gun or a gun accessory; and

(d)

the person is not one of the following:(i)

a person granted a licence to repair the gun or gun accessory;

(ii)

a class licensee authorised under a class licence to repair the gun or gun accessory;

(iii)

a person exempt from this section under section 87, 88 or 89 in relation to the repair of the gun or gun accessory.

(3) To avoid doubt, subsections (1) and (2) apply to a person regardless that the gun, major part of a gun or gun accessory concerned was manufactured, disposed of or repaired other than in the course of carrying on a business.

(2) A person commits an offence if —(a)

the person repairs or takes part in the repair of any object or thing;

(b)

the object or thing is a gun or a gun accessory;

(c)

the person knows that or is reckless as to whether the object or thing is a gun or a gun accessory; and

(d)

the person is not one of the following:(i)

a person granted a licence to repair the gun or gun accessory;

(ii)

a class licensee authorised under a class licence to repair the gun or gun accessory;

(iii)

a person exempt from this section under section 87, 88 or 89 in relation to the repair of the gun or gun accessory.
