§ 27 — Penalties for offences for unlicensed regulated activities involving explosives, etc.
27. A person who is guilty of an offence under section 21(1), 22(1) or (3), 23(1) or (4), 24(1), 25(1) or 26(1) or (2) shall —(a)
if a prohibited explosive is involved, be punished on conviction with —(i)
where the person is an individual — imprisonment for a term not exceeding 5 years and a fine not exceeding $100,000; or
(ii)
in any other case — a fine not exceeding $200,000;
(b)
if an explosive other than a prohibited explosive is involved, be punished on conviction with —(i)
where the person is an individual — imprisonment for a term not exceeding 36 months and a fine not exceeding $50,000; or
(ii)
in any other case — a fine not exceeding $100,000; or
(c)
where an explosive precursor is involved, be liable on conviction —(i)
where the person is an individual — to a fine not exceeding $50,000 or to imprisonment for a term not exceeding 24 months or to both; or
(ii)
in any other case — to a fine not exceeding $100,000.
