§ 29 — Unauthorised possession of weapons and noxious substances

29.—(1) A person commits an offence if —(a)

the person possesses a weapon or noxious substance at any place or premises; and

(b)

the person is not one of the following:(i)

a person granted a licence to possess that weapon or noxious substance at that place or premises;

(ii)

a class licensee authorised under a class licence to possess that weapon or noxious substance at that place or premises;

(iii)

a person exempt from this section under section 87, 88 or 89 in relation to the possession of that weapon or noxious substance at that place or premises.

(2) To avoid doubt, subsection (1)(a) applies to a person regardless that the weapon or noxious substance concerned was in the person’s possession other than in the course of carrying on a business.
