§ 31 — Unauthorised trade in weapons or noxious substances

31. A person commits an offence if —(a)

the person —(i)

imports or exports an object or a thing; or

(ii)

takes part in any activity in sub‑paragraph (i) in relation to an object or a thing;

(b)

the object or thing is a weapon or noxious substance;

(c)

the person knows that, or is reckless as to whether, the object or thing is a weapon or noxious substance; and

(d)

the person is not one of the following:(i)

a person granted a licence to import or export that weapon or noxious substance;

(ii)

a class licensee authorised under a class licence to import or export that weapon or noxious substance;

(iii)

a person exempt from this section under section 87, 88 or 89 in relation to the import or export of that weapon or noxious substance.
