§ 61 — Record-keeping and giving information

61.—(1) A licensee must —(a)

keep and retain, for such period as may be prescribed, records, where the records are relevant to monitoring or evaluating, under this Act, an aspect of the regulated activity as prescribed in the Regulations; and

(b)

give to the Licensing Officer, within the period and in the manner specified in the licence, information that is relevant to monitoring or evaluating, under this Act, an aspect of the regulated activity mentioned in paragraph (a).

(2) A class licensee must —(a)

keep and retain, for such period as may be prescribed in the class licence applicable to the class licensee, records where the records are relevant to monitoring or evaluating, under this Act, an aspect of the regulated activity as specified in the class licence; and

(b)

give to the Licensing Officer, within the period and in the manner prescribed in the class licence applicable to the class licensee, information that is relevant to monitoring or evaluating, under this Act, an aspect of the regulated activity as specified in the class licence.

(3) A person who is subject to a requirement under subsection (1) or (2) to keep and retain or give any record or information commits an offence if the person —(a)

intentionally or negligently contravenes the requirement under subsection (1) or (2) to keep, retain or give;

(b)

intentionally alters, suppresses or destroys any record or information which the person is required under subsection (1) or (2) to keep, retain or give; or

(c)

who, in keeping, retaining or giving the record or information required under subsection (1) or (2), makes any statement which the person knows to be false in a material particular, or recklessly makes such a statement.

(4) A person who is guilty of an offence under subsection (3) shall be liable on conviction to a fine not exceeding $10,000.

give to the Licensing Officer, within the period and in the manner prescribed in the class licence applicable to the class licensee, information that is relevant to monitoring or evaluating, under this Act, an aspect of the regulated activity as specified in the class licence.

(3) A person who is subject to a requirement under subsection (1) or (2) to keep and retain or give any record or information commits an offence if the person —(a)
