§ 67 — Regulatory action can continue despite licence expiry, etc.

67.—(1) Subject to section 68, regulatory action started under section 66 against a licensee or class licensee may continue, and a Licensing Officer may exercise any powers under subsection (2), in relation to a former licensee or former class licensee, despite either of the following events:(a)

the date of expiry of the licensee’s licence;

(b)

the date the class licence stops applying.

(2) The Licensing Officer may, if satisfied of any ground mentioned in section 66(1), do (without compensation) any one or more of the following:(a)

censure the former licensee or former class licensee in writing;

(b)

direct the former licensee or former class licensee to do, or to refrain from doing, such things as are specified in a direction to rectify any contravention or non‑compliance mentioned in section 66(1)(a) by the former licensee or former class licensee when the licence or class licence was in force.

(3) Section 66(3) and (4) applies to regulatory action under this section as it applies to any regulatory action under that section.

(4) A person to whom a direction is given under subsection (2)(b) commits an offence if the person intentionally or negligently fails to comply with the direction, and shall be liable on conviction —(a)

where the person is an individual — to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both; or

(b)

where the person is not an individual — to a fine not exceeding $20,000.

—(1) Subject to section 68, regulatory action started under section 66 against a licensee or class licensee may continue, and a Licensing Officer may exercise any powers under subsection (2), in relation to a former licensee or former class licensee, despite either of the following events:(a)

the date of expiry of the licensee’s licence;

(b)

the date the class licence stops applying.

(2) The Licensing Officer may, if satisfied of any ground mentioned in section 66(1), do (without compensation) any one or more of the following:(a)

censure the former licensee or former class licensee in writing;

(b)

direct the former licensee or former class licensee to do, or to refrain from doing, such things as are specified in a direction to rectify any contravention or non‑compliance mentioned in section 66(1)(a) by the former licensee or former class licensee when the licence or class licence was in force.

(3) Section 66(3) and (4) applies to regulatory action under this section as it applies to any regulatory action under that section.

(4) A person to whom a direction is given under subsection (2)(b) commits an offence if the person intentionally or negligently fails to comply with the direction, and shall be liable on conviction —(a)

where the person is an individual — to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 12 months or to both; or

(b)

where the person is not an individual — to a fine not exceeding $20,000.
