§ 2 — Repeal of Reciprocal Enforcement of Commonwealth Judgments Act
2.—(1) The Reciprocal Enforcement of Commonwealth Judgments Act (called in this Act the repealed Act) is repealed.(2) Despite subsection (1) —(a)
sections 2A and 3(1) and (2) of the repealed Act as in force immediately before the date of commencement of this Act (called in this Act the appointed date) continue to apply to a judgment obtained before that date —(i)
in a superior court of the United Kingdom of Great Britain and Northern Ireland; or
(ii)
in such court of such part of the Commonwealth as is specified in a notification under section 5 of the repealed Act that was in force immediately before that date;
(b)
sections 2A and 3(3) of the repealed Act as in force immediately before the appointed date continue to apply to a judgment registered under section 3(1) and (2) of the repealed Act, including those provisions as applied by paragraph (a);
(c)
sections 2A and 3(5) of the repealed Act as in force immediately before the appointed date continue to apply to a judgment mentioned in paragraph (a) registrable under the repealed Act, including by the application of that paragraph; and
(d)
section 4 of the repealed Act as in force immediately before the appointed date continues to apply to a judgment obtained in the General Division of the High Court before that date.[Act 40 of 2019 wef 01/03/2023]
—(1) The Reciprocal Enforcement of Commonwealth Judgments Act (called in this Act the repealed Act) is repealed.
(2) Despite subsection (1) —(a)
sections 2A and 3(1) and (2) of the repealed Act as in force immediately before the date of commencement of this Act (called in this Act the appointed date) continue to apply to a judgment obtained before that date —(i)
in a superior court of the United Kingdom of Great Britain and Northern Ireland; or
(ii)
in such court of such part of the Commonwealth as is specified in a notification under section 5 of the repealed Act that was in force immediately before that date;
(b)
sections 2A and 3(3) of the repealed Act as in force immediately before the appointed date continue to apply to a judgment registered under section 3(1) and (2) of the repealed Act, including those provisions as applied by paragraph (a);
(c)
sections 2A and 3(5) of the repealed Act as in force immediately before the appointed date continue to apply to a judgment mentioned in paragraph (a) registrable under the repealed Act, including by the application of that paragraph; and
(d)
section 4 of the repealed Act as in force immediately before the appointed date continues to apply to a judgment obtained in the General Division of the High Court before that date.[Act 40 of 2019 wef 01/03/2023]
