s 39 Appointment of salespersons
39.—(1) An estate agent must not appoint, associate with, employ or continue to employ as a salesperson any person who for the time being is not a registered salesperson. (2) Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $25,000 or to imprisonment for a term not exceeding 12 months or to both and, in the case of a continuing offence, to a further fine not exceeding $2,500 for every day or part of a day during which the offence continues after conviction for each salesperson appointed, associated or employed in contravention of subsection (1), as the case may be.
