s 40Q Obligations of competent person
40Q.—(1) Unless granted a waiver under section 40Y, a competent person carrying out or supervising the carrying out of any regulated GHG works must —(a) comply with any policies, procedures and processes mentioned in section 40P(1)(b) in relation to the regulated GHG works; and (b) ensure that the regulated GHG works are carried out safely and in the prescribed manner. (2) A competent person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction —(a) for a first offence, to a fine not exceeding $10,000; and (b) for a second or subsequent offence, to a fine not exceeding $20,000 and, in the case of a continuing offence, to a further fine not exceeding $1,000 for every day or part of a day during which the offence continues after conviction.[Act 24 of 2021 wef 01/10/2022]
