s 29 Maintenance, etc., of gas service pipes and gas installations
29.—(1) A gas transporter must carry out any necessary work of maintenance, repair or renewal of —(a) any part of a gas service pipe from a gas main up to a gas service isolation valve; and (b) that gas service isolation valve, by which gas is conveyed to a consumer’s premises, whether or not the gas service pipe was supplied and laid at the gas transporter’s expense. [24/2007] (2) The cost of any work carried out under subsection (1) is to be paid as follows:(a) in the case of work made necessary by any intentional or negligent act of the consumer, by the consumer if the gas transporter requires the consumer to pay; (b) in any other case, by the gas transporter.[24/2007] (3) The Authority may, from time to time, prescribe by order in the Gazette such person or class of persons to be responsible for the inspection, maintenance, repair or renewal of any part of a gas installation.[24/2007] [Act 31 of 2022 wef 01/09/2025] [Act 27 of 2024 wef 01/09/2025] (4) The gas transporter must —(a) establish and implement a programme for regular and periodic inspections of any part of a gas installation and provide in the programme, in relation to each such inspection, whether this is the responsibility of the gas transporter or any other person prescribed under subsection (3);[Act 31 of 2022 wef 01/09/2025] [Act 27 of 2024 wef 01/09/2025] (b) where any inspection is the responsibility of any person prescribed under subsection (3) (other than the gas transporter), notify the person of the person’s responsibility to ensure that the inspection is carried out; and[Act 31 of 2022 wef 01/09/2025] (c) where any maintenance, repair or renewal is necessary following any inspection by the gas transporter or the person notified under paragraph (b), notify the person prescribed under subsection (3) to be responsible for the maintenance, repair or renewal of that part of the gas installation or gas service pipe (if the person is not the gas transporter), of the person’s responsibility to ensure that the maintenance, repair or renewal is carried out.[Act 37 of 2021 wef 01/09/2025] [Act 31 of 2022 wef 01/09/2025] (5) Where any person prescribed under subsection (3) is responsible under subsection (4)(b) or (c) for ensuring that any inspection, maintenance, repair or renewal is carried out, the inspection, maintenance, repair or renewal is to be carried out at the expense of the person.[Act 37 of 2021 wef 01/09/2025] (6) Any person prescribed under subsection (3) who fails to carry out the person’s responsibility under subsection (4)(b) or (c) shall be guilty of an offence.[Act 37 of 2021 wef 01/09/2025]
