s 4 Prescribed minimum retirement age

4.—(1) The Minister may, by notification in the Gazette, specify the prescribed minimum retirement age applicable to any class of employees, which must be at least 62 years but not more than 65 years.[Act 38 of 2021 wef 01/07/2022] (2) Despite any other written law, contract of service or collective agreement, an employer must not dismiss an employee on the ground of age before that employee attains the employee’s prescribed minimum retirement age.[Act 38 of 2021 wef 01/07/2022] (3) An employer who contravenes subsection (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $5,000 or to imprisonment for a term not exceeding 6 months or to both.[Act 38 of 2021 wef 01/07/2022]
