Securities and Futures Act 2001 s 46C

s 46C Holding out as licensed trade repository or licensed foreign trade repository

46C.—(1) A person must not hold out that the person is —(a) a licensed trade repository, unless the person has in force a trade repository licence granted by the Authority under section 46E(1); or (b) a licensed foreign trade repository, unless the person has in force a foreign trade repository licence granted by the Authority under section 46E(2).[34/2012] (2) Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 and, in the case of a continuing offence, to a further fine not exceeding $2,000 for every day or part of a day during which the offence continues after conviction.[34/2012]
