s 76 Obligation to notify Authority of certain matters
76.—(1) A recognised clearing house must, as soon as practicable after the occurrence of any of the following circumstances, give the Authority notice of the circumstance:(a) any material change to the information provided by the recognised clearing house in its application under section 50(1) or (2) or 54(1); (b) the recognised clearing house becoming aware of any financial irregularity or other matter which in its opinion —(i) may affect its ability to discharge its financial obligations; or (ii) may affect the ability of a member of the recognised clearing house to meet its financial obligations to the recognised clearing house; (c) any other matter that the Authority may —(i) prescribe by regulations made under section 81Q for the purposes of this paragraph; or (ii) specify by written notice to the recognised clearing house in any particular case.[34/2012] (2) A recognised clearing house must notify the Authority of any matter that the Authority may prescribe by regulations made under section 81Q for the purposes of this subsection, no later than such time as the Authority may prescribe by those regulations.[34/2012] (3) A recognised clearing house must notify the Authority of any matter that the Authority may specify by written notice to the recognised clearing house, no later than such time as the Authority may specify in that notice.[34/2012]
