s 40 Board’s symbol

40.—(1) The Board has the exclusive right to the use of the Board’s symbol, a representation of which is set out in Part 2 of the Schedule. (2) Any person who, without the permission of the Board, uses the Board’s symbol, or a symbol or representation so nearly resembling the Board’s symbol as to cause confusion in relation to it, shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 6 months or to both.[25
