The guarantee schemes of the Länder of Saxony-Anhalt, North Rhine-Westphalia, Rhineland-Palatinate, Bavaria, Bremen, Mecklenburg-Western Pomerania, Schleswig-Holstein, and Saxony are incompatible with the common market in that they provide for the provision of guarantees for measures to restructure large firms in difficulty (including reorganization and consolidation projects) without advance notification to the Commission.
Individual cases in which guarantees under these schemes are to be provided for measures to restructure large firms in difficulty shall be notified to the Commission in accordance with Article 93 (3) of the EC Treaty so as to enable it to establish whether they are compatible with the common market.
