Article 1

The national provisions imposing a mandatory limit value for the emissions of particulate matter of 5 mg per kilometre on commercial vehicles with a maximum permissible weight of 1 305 kg (N 1 vehicles, class I) and passenger cars (M 1 vehicles) notified by the Kingdom of the Netherlands pursuant to Article 95(5) of the EC Treaty are rejected.

Article 2

This Decision is addressed to the Kingdom of the Netherlands.
