Commission Implementing Regulation (EU) 2016/2141 of 6 December 2016 amending Regulation (EC) No 1238/95 as regards the level of the annual fee and of the examination fees payable to the Community Plant Variety Office

Article 1

Regulation (EC) No 1238/95 is amended as follows:

(1)

in Article 9, paragraph 1 is replaced by the following:

‘1.   The Office shall charge a holder of a Community plant variety right (‘the holder’) a fee of EUR 330 for each year of the duration of a Community plant variety right (‘annual fee’), as referred to in Article 113(2)(d) of the Basic Regulation.’;

(2)

Annex I is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

It shall apply from 1 January 2017.
