Open ↗28.7.2022 EN Official Journal of the European Union C 287/19 COMMISSION DECISION of 26 July 2022 on the conclusion of an Agreement in the form of an Exchange of Letters between the European Union and the Republic of Chile concerning amendments to Appendices I, II, V and VIII to the Agreement on Trade in Wines (Annex V), annexed to the Association Agreement between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part (2022/C 287/05) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Council Decision 2005/269/EC of 28 February 2005 on the conclusion of the Agreement establishing an association between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part ( 1 ) , Whereas: (1) The Parties held discussions with view to amend several of the Appendices to the Agreement on Trade in Wines (Annex V) and to the Agreement on Trade in Spirit Drinks and Aromatised Drinks (Annex VI) to the Association Agreement between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part. In particular, the Parties discussed Appendices I, II, V and VIII to the Agreement on Trade in Wines. (2) The Parties notified each other up-dated lists of geographical indications and satisfactorily completed the objection and examination procedures of new geographical indications to be protected under the Agreement on Trade in Wines. (3) The Parties also agreed on a new simplified procedure for the addition of new geographical indications to Appendices I and II to the Agreement on Trade in Wines. (4) New oenological practices and processes authorised in the European Union and Chile were notified in accordance with Article 18 of the Agreement on Trade in Wines. Pursuant to Articles 21 and 22 of that Agreement they should be added to Appendix V thereto. (5) The Parties adopted new import certification requirements for wine products entering their respective territories, which should be added to Appendix VIII to the Agreement on Trade in Wines. (6) Taking account of the conclusions of the 11 th EU-Chile Joint Committee of the Agreement on Trade in Wines that was held in Brussels on 13 November 2017, it is necessary to replace Appendices I and II to the Agreement on Trade in Wines with a new list of geographical indications from the European Union and Chile. It is furthermore necessary to modify Appendix V to the Agreement on Trade in Wines to take into account new wine-making practices of the Parties and to modify Appendix VIII to the Agreement on Trade in Wines in the light of new certification rules adopted by the Parties. (7) The Union and Chile have therefore negotiated an agreement in the form of an Exchange of Letters. Part (1) of the Annex to the Agreement in the form of an Exchange of Letters amends Appendices I, II, V and VIII to the Wine Agreement in accordance with Article 29(2) of that Agreement ( 2 ) . (8) The Agreement in the form of an Exchange of Letters concerning the amendments to the Agreement on Trade in Wines should therefore be approved. (9) The amendments to the Agreement on Trade in Wines provided for in this Decision are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, HAS DECIDED AS FOLLOWS: Article 1 The Agreement in the form of an Exchange of Letters between the European Union and the Republic of Chile concerning amendments to Appendices I, II, V and VIII to the Agreement on Trade in Wines (Annex V), annexed to the Association Agreement between the European Community and its Member States, of the one part, and the Republic of Chile, of the other part, is hereby approved on behalf of the Union. The text of the Agreement in the form of an Exchange of Letters and Appendices I, II, V and VIII to the Agreement on Trade in Wines (Part (1) of the Annex) are attached to this Decision. Article 2 The Member of the Commission responsible for Agriculture is hereby authorised to sign the Agreement and to deposit the instrument of approval provided for in the Agreement in order to express the consent of the Union to be bound by the Agreement ( 3 ) . In these discussions it has been concluded that Appendices I (Geographical indications of wines originating in the Community), II (Geographical indications of wines originating in Chile), V (Oenological practices and processes and product specifications) and VIII (Protocol) to the Agreement on Trade in Wines, and Appendix I (Protected designations for spirit drinks and aromatised drinks) to the Agreement on Trade in Spirit Drinks and Aromatised Drinks, shall be amended by the Appendices attached to the Annex hereto. I have the honour to propose that Appendices I, II, V and VIII to the Agreement on Trade in Wines and Appendix I to the Agreement on Trade in Spirit Drinks and Aromatised Drinks be replaced by the Appendices attached to the Annex hereto. I have the further honour to propose that this letter and your letter of confirmation in reply shall constitute an agreement between the European Union and the Republic of Chile, which shall enter into force 90 days following the date of your letter of confirmation in reply. In principle, once a year, at the occasion of a meeting of the Joint Committee referred to in Article 30 of the Agreement on Trade in Wines, the European Union may propose the addition of further geographical indications relating to wines to the list of this Appendix. At the same time, the European Union may also propose the withdrawal of geographical indications from the list in this Appendix or the change of names of geographical indications in the list in this Appendix. 2. The proposal should take the form of a notification addressed to Chile and should be submitted through the Joint Committee referred to in Article 30 of the Agreement on Trade in Wines. The proposal must specify whether an addition, withdrawal or change of a name of a geographical indication is requested and indicate the Member State(s) of the European Union that is (are) concerned by the geographical indication. The request shall include evidence that the geographical indication proposed to be newly added on the list of this Appendix is protected as such in the European Union. 3. Chile shall examine the proposal referred to in paragraphs 1 and 2 in line with its international commitments under the Agreemet on Trade in Wines and in accordance with its national laws and procedures, within a period that should not exceed 12 months from the date of the receipt of the notification referred to in paragraph 2. 4. At the end of the examination of the proposal, or after the expiry of the period referred to in paragraph 3, Chile shall communicate the outcome of the examination of the proposal to the European Union. Any outcome of the examination resulting in a rejection of the proposal must be justified. In case of rejection, the European Union shall be given the opportunity to present written arguments against the rejection. The European Union shall submit its written argument within a period that should not exceed 90 days after rejection. Chile shall communicate its final determination to the European Union within 90 days after receiving the written arguments. 5. The proposed modifications of the list in this Appendix, referred to in paragraphs 1 to 4, shall be discussed at the next meeting of the Joint Committee referred to in Article 30 of the Agreement on Trade in Wines. (ii) Commission Delegated Regulation (EU) 2019/33 ( 6 ) , in particular Articles 47, 52, 53 and 54 and Annexes III, V and VI to that Regulation. (b) Oenological practices and restrictions authorised in the European Union by laws and regulations referred to in the following list, in so far as they are recommended and published by the OIV: (i) Regulation (EU) No 1308/2013, in particular production rules in the wine sector, in accordance with Articles 80 and 83 and Annex VIII to that Regulation, including subsequent modifications. (ii) Commission Delegated Regulation (EU) 2019/934 ( 7 ) , including subsequent modifications. (c) Additional oenological practices and restrictions jointly accepted by the Parties under the conditions provided for as follows: (i) concentrated grape must, rectified concentrated grape must and sucrose, may be used for enrichment and sweetening under the specific and limited conditions set out in Part I of Annex VIII to Regulation (EU) No 1308/2013, subject to the exclusion of use of these products in a reconstituted form in wines covered by this Agreement; (ii) addition of water: The addition of water in winemaking is excluded, except where required on account of a specific technical necessity; (iii) fresh lees may be used under the specific and limited conditions set out in line item 11.2 of Table 2 of Part A of Annex I to Delegated Regulation (EU) 2019/934. ’ (d) Point VI of Appendix VIII (Protocol) is replaced by the following: ‘VI. Specific provisions applicable to documents to be used on import in the respective territories of the parties: 1. For wine products imported from Chile and placed on the market in the European Union, the certification that may be required by the European Union shall be limited to that set out in the VI-1 document provided for in Article 20 of Commission Delegated Regulation (EU) 2018/273 ( 8 ) , including the exemption of filling in a reduced number of parameters in the anlysis report as referred to in Article 21, point (b), of that Regulation, and referred to in Chilean Circular n° 3361/2013 ( 9 ) . Those wine products may be also imported in accordance with the simplified procedure laid down in Article 26 of Delegated Regulation (EU) 2018/273 provided that the wine producers have received an individual authorisation from the competent bodies in the importing country and are subject to inspection by the latter. For the implementation of the above, Chile should notify the European Union of the relevant names, addresses and registration numbers as laid down in Article 51 of Delegated Regulation (EU) 2018/273. 2. For wine products imported from the European Union and placed on the market in Chile, the certification that may be required by Chile, in accordance with Circular n° 3361/2013, shall be limited to a commercial document stating the unique reference number of the accompanying document issued by the competent authority of the European Union’s Member State of dispatch of the products as referred to in Article 10(1), first subparagraph, point (a)(i) or (iii), of Delegated Regulation (EU) 2018/273. 3. Each party may modify its respective form, referred to in paragraphs 1 and 2, in accordance with its internal procedures, in which case the Party concerned shall give due notice to the other Party. The Parties shall, as necessary, amend this Appendix in accordance with Articles 29 and 30 of the Agreement on Trade in Wines and make available to the public in an appropriate manner the applicable forms.’; (2) Annex VI (Agreement on Trade in Spirit Drinks and Aromatised Drinks) is amended as follows ( 10 ) : (…) ( 1 ) The geographical indication “DUNA” shall contain in the label an indication, directly associated with the designation “DUNA”, stipulating that it is a wine from the wine-growing region known as “DUNA” in Hungary in order to avoid any possible confusion with the prior registered trade mark “DUNA” in Chile. ( 2 ) Law No. 18.455 of 1985, which “Sets rules on the production, processing and marketing of ethyl alcohol, alcoholic beverages and vinegars, and repeals Book I of Law No. 17.105” ( Ley N° 18.455 de 1985, que “Fija normas sobre producción, elaboración y comercialización de alcoholes etílicos, bebidas alcohólicas y vinagres, y deroga libro I de la Ley N° 17.105”). ( 3 ) Decree No. 78 of 1986, which “Regulates Law No. 18.455, which establishes rules on the production, processing and marketing of ethyl alcohol, alcoholic beverages and vinegars” ( Decreto N° 78 de 1986, que “Reglamenta Ley N° 18.455 que fija normas sobre producción, elaboración y comercialización de alcoholes etílicos, bebidas alcohólicas y vinagres .”). ( 4 ) Decree No. 9 of 2019, amending Decree No. 78 of 1986, of the Ministry of Agriculture, which regulates Law No. 18.455, which "Sets rules on production, processing and marketing of ethyl alcohol, alcoholic beverages and vinegars.
