Article 1

The reports referred to in Article 26 of Regulation (EU) 2024/573 shall be based on the format set out in the Annex to this Regulation.

Article 2

Implementing Regulation (EU) No 1191/2014 is repealed.

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

ANNEX GENERAL EXPLANATIONS Unless otherwise stated in the reporting sections of this Annex, the reported data shall cover the activities of the undertaking during the calendar year for which the report is submitted. The units of measurement, the gases covered, the level of detail and an indication of the year in which activities are to be reported are specified separately in each reporting section. The general format of the reporting tool is set out in the following reporting sections. REPORTING SECTIONS Section 1: To be filled in by producers of gases – Article 26(1), first subparagraph, Article 26(2) and (3), of Regulation (EU) 2024/573 and point 1(a) of Annex IX to that Regulation Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each gas listed in Annexes I, II or III to Regulation (EU) 2024/573. INFORMATION TO BE REPORTED COMMENTS 1A Total quantity of production from facilities in the Union Including amounts produced as by-products and amounts not captured. 1Aa — thereof: Amounts not captured 1A_a — thereof: Amounts destroyed If the in-line destruction is carried out by another undertaking, that undertaking should be specified. Reports from producers which carry out destruction on the total quantities destroyed shall be made in reporting Section 8. Quantities of hydrofluorocarbons shall be reported separately for each country of origin, except where indicated otherwise in the following table. Only bulk imports shall be reported in this section, including quantities shipped alongside equipment for the purpose of charging that equipment after import, but not quantities contained in equipment. Imports of gases contained in products or equipment shall be reported under Section 11. All imports shall be reported, except goods under temporary storage. INFORMATION TO BE REPORTED COMMENTS 2A Total amount imported into the Union All imports to be reported except goods under temporary storage. 2B — thereof: Amount imported into the Union by the reporting undertaking, including amounts purchased or received from other undertakings under a special customs procedure, not released for free circulation, and re-exported contained in products or equipment by the reporting undertaking Reporting by country of origin is not necessary. Bulk gases imported for inward processing, charged into products or equipment and subsequently re- exported. Where the re-export of products or equipment (Section 2B) does not take place in the same calendar year as the import or purchase, the quantities reported in Section 2B may include re-exports in products or equipment of 1 January stocks not placed on the Union market as reported in Section 4C. The type of re-exported products or equipment use shall be specified. Bulk gas exports shall only be reported in Section 3. 2C — thereof: Amount of used, recycled or reclaimed hydrofluorocarbons 2D — thereof: Amount of virgin hydrofluorocarbons imported for feedstock use The type of feedstock use shall be reported. 2E — thereof: Amount of virgin hydrofluorocarbons imported for uses exempted under the Montreal Protocol The type of exempted use shall be specified. 2F — thereof: Amount of hydrofluorocarbons contained in pre-blended polyols 2G Amounts under special customs procedures, purchased/received from other undertakings Includes amounts imported, but not placed on the market, by other undertakings. Reporting by country of origin is not required. 2H Amounts under special customs procedures that have been sold or supplied to other undertakings Sales of amounts reported in 2A and/or 2G, where those have not been placed on the market by the reporting undertaking. Reporting by country of origin is not required. The undertaking/s in receipt of reported amounts shall be specified. 2I Amount emitted under special customs procedures Emissions from amounts reported in 2A and/or 2G, where those have not been placed on the market by the reporting undertaking. Reporting by country of origin is not required. An explanation for the emissions shall be provided. Section 3: To be filled in by exporters of gases – Article 26(1), first subparagraph, of Regulation (EU) 2024/573 and point 3 of Annex IX to that Regulation Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each gas listed in Annexes I, II or III to Regulation (EU) 2024/573, for mixtures containing at least one of those gases or for each gas or mixture contained in exported pre-blended polyols. Quantities of hydrofluorocarbons shall be reported separately for each country of destination, except where indicated otherwise in the following table. Only exports of bulk gases, including any quantities shipped alongside equipment for the purpose of charging that equipment after export, shall be reported under this section. Quantities from own production supplied to other undertakings in the Union for direct export, or own imports released for free circulation and exported either by the importer itself or supplied to other undertakings in the Union for direct export, shall be reported in reporting Section 5. INFORMATION TO BE REPORTED COMMENTS 3A Total amount exported from the Union 3B — thereof: Export of amounts not placed on the market Shall include amounts exported from own production not placed on the market, from own imports not placed on the market and from amounts purchased under special customs procedures and not placed on the market before their export. Reporting by country of destination is not required. INFORMATION TO BE REPORTED COMMENTS 5A Quantity imported into the Union for destruction The undertaking/s carrying out the destruction shall be specified. Reports from importers that also carry out destruction themselves on the quantities destroyed shall be made in reporting Section 8. 5B Quantity used by a producer or importer in feedstock applications or supplied directly by a producer or an importer to undertakings for use in feedstock applications The feedstock using undertaking/s shall be specified. The type of feedstock use shall be reported. Reports from producers or importers which are also feedstock users themselves on their feedstock use shall be made in reporting Section 7. 5C Quantity supplied directly to undertakings for export out of the Union, where those quantities were not subsequently made available to another party within the Union prior to export Quantities that undertakings released for free circulation and directly exported themselves shall also be reported here. Note that all gases to be reported here must have been labelled as ‘for direct export out of the EU only’ at the time of release for free circulation in line with Article 12(9) of Regulation (EU) 2024/573. Quantities imported under special customs procedures and sold or supplied to other undertakings during those procedures for re-export shall only be reported in Section 2H. The exporting undertaking/s shall be specified. Verification documents should be provided. Only hydrofluorocarbons in bulk shall be reported, not quantities contained in products or equipment. 5D Quantity supplied directly for use in military equipment The undertaking receiving the quantity for use in military equipment shall be specified. 5E Quantity supplied directly to an undertaking using it for the etching of semiconductor material or the cleaning of chemicals vapour deposition chambers within the semiconductor manufacturing sector The receiving semiconductor manufacturer shall be specified. 5F Quantity supplied directly to an undertaking producing metered dose inhalers for the delivery of pharmaceutical ingredients The receiving producer of metered dose inhalers for the delivery of pharmaceutical ingredients shall be specified. Section 5a: Quantities for uses exempted under Article 16(2) of Regulation (EU) 2024/573 and for producing metered dose inhalers for the delivery of pharmaceutical ingredients, to be filled in by recipients of hydrofluorocarbons – Article 26(5) of Regulation (EU) 2024/573 and point 7 of Annex IX to that Regulation Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each hydrofluorocarbon (for gases listed in Section 1 of Annex I to Regulation (EU) 2024/573, for mixtures or pre-blended polyols containing at least one of those gases). INFORMATION TO BE REPORTED COMMENTS 6A Export For hydrofluorocarbons, the amount reported here (6A) shall be the same amount or higher as that reported in reporting Section 5, as supplied directly to undertakings for export out of the Union, where those quantities were not subsequently made available to any other party within the Union, prior to export reported under 5C. 6B Destruction For hydrofluorocarbons, the amount reported here (6B) shall be the same amount or higher as that reported in reporting Section 5, as imported into the Union for destruction reported under 5A. 6C Military equipment For hydrofluorocarbons, the amount reported here (6C) shall be the same amount or higher as that reported in reporting Section 5 as supplied directly for use in military equipment reported under 5D. 6D Refrigeration, air-conditioning and heat pumps 6E Other heat transfer fluids 6F Production of foams 6G Production of pre-blended polyols 6H Fire protection 6I Aerosols – metered dose inhalers For hydrofluorocarbons, the amount reported here (6I) shall be the same or higher as that reported in reporting Section 5 as supplied directly to an undertaking producing metered dose inhalers for the delivery of pharmaceutical ingredients (5F). 6J Aerosols – other uses 6K Solvents 6L Feedstock For hydrofluorocarbons, the amount reported here [6L] shall be the same or higher as that reported in reporting Section 5 as used by a producer or importer in feedstock applications or supplied directly by a producer or an importer to undertakings for use in feedstock applications (5B). AUTOMATICALLY CALCULATED QUANTITIES 6W Total quantities for the categories for applications 6W = 6A + 6B + 6C + 6D + 6E + 6F + 6G + 6H + 6I + 6J + 6K + 6L + 6M + 6N + 6O + 6P + 6Q + 6R + 6S + 6T + 6U + 6V If data are reported correctly, then the total quantities for the categories of applications (6W) will correspond to the calculated total quantity supplied to the Union market (6X). 6X Total quantity supplied to the Union market 6X = 1E + 2A + 2G – 2H – 3B + 4B – 4G + 4K Section 7: To be filled in by feedstock users of gases – Article 26(3) of Regulation (EU) 2024/573 and point 5 of Annex IX to that Regulation Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each gas listed in Annex I to Regulation (EU) 2024/573 or mixture containing at least one of those gases. Only quantities actually used as feedstock shall be reported in this section. Where hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573 or mixture containing at least one of those gases) were produced or imported by the undertaking using them as the feedstock, the quantities used shall also be reported in Section 5. Where hydrofluorocarbons were produced by the undertaking using them as the feedstock, the quantities used shall also be reported in Section 1. Where an undertaking produced or imported hydrofluorocarbons and subsequently sold them for use as feedstock to other undertakings, the quantities supplied shall not be reported in this section, but only in reporting Section 5, specifying the feedstock using undertaking, and in the case of producers those shall also be reported in reporting Section 1, specifying the Member State where the feedstock use takes place. INFORMATION TO BE REPORTED COMMENTS 7A Amount used as feedstock by the undertaking itself The type of feedstock use shall be reported. 7A_a thereof: amount of virgin gases To be reported for HFC-23 only. Section 8: To be filled in by undertakings having destroyed gases – Article 26(2) of Regulation (EU) 2024/573 and point 4 of Annex IX to that Regulation Quantities shall be reported in metric tonnes with accuracy to the third decimal place (if the fourth decimal place is 5 or more, the third decimal place shall be rounded up, otherwise it shall be rounded down), separately for each fluorinated greenhouse gas listed in Annexes I, II or III to Regulation (EU) 2024/573, or mixture containing at least one of those gases. For hydrofluorocarbons, the destruction technology approved under the Montreal Protocol shall be specified, differentiating concentrated sources (such as recovered refrigerants) and dilute sources (such as waste streams containing foams). The total quantities destroyed by the reporting undertakings themselves shall be reported. Undertakings which are producers shall also report on the quantities of their own production which has been destroyed, in reporting Section 1. Undertakings which are importers of hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573, or mixture containing at least one of those gases) shall also report the quantities of their own imports which have been destroyed, in reporting Section 5. Quantities sent for destruction to other undertakings in the Union shall not be reported in this section. Quantities exported for destruction outside the Union shall be reported in Section 3G. INFORMATION TO BE REPORTED COMMENTS 8_A Amount destroyed by the reporting company using thermal oxidation For hydrofluorocarbons, the destruction technology approved under the Montreal Protocol shall be specified, differentiating concentrated and dilute sources. 8_A_a — thereof: amount of destroyed virgin gases (including amounts produced as by-products and destroyed) To be reported for HFC-23 only. In addition to the total quantity of gases, the number of units shall be reported per category, unless otherwise stated. For Section 11_M, the number of units shall refer to the number of functional units and shall be reported on with the associated quantities of substances. Producers of products or equipment or parts thereof manufactured in the Union shall not report on products and equipment or parts thereof where the contained gases were previously imported into or produced in the Union. Where a producer itself produces bulk gas in the Union for use in the Union for manufacturing their products and equipment or parts thereof, its reporting on production (reporting Section 1) shall also cover the relevant gas amounts, so those amounts shall not be reported in this Section, but only in reporting Section 1. Importers of products or equipment or parts thereof containing a fluorinated greenhouse gas listed in Annexes I, II and III to Regulation (EU) 2024/573 shall report on all gas containing imports released by customs for free circulation in the Union. Imports of pre-blended polyols shall not be reported in this Section, but only in Section 2. Where hydrofluorocarbons (gases listed in Section 1 of Annex I to Regulation (EU) 2024/573 or mixtures containing at least one of those gases) contained in imported refrigeration, air conditioning equipment or heat pumps or in imported metered dose inhalers for the delivery of pharmaceutical ingredients had previously been exported from the Union, and had been subject to the hydrofluorocarbon quota limitation for placing on the Union market, that shall be reported in reporting Section 12 in order to prove compliance with Article 19 of Regulation (EU) 2024/573. Where imported refrigeration equipment, air conditioning equipment or heat pumps or parts thereof or imported metered dose inhalers for the delivery of pharmaceutical ingredients containing hydrofluorocarbons had previously been placed on the Union market (including the charge of hydrofluorocarbons) and had subsequently been exported from the Union prior to re-import, that shall be reported in reporting Section 12a to prove compliance with Article 19 of Regulation (EU) 2024/573. The following categories of products or equipment or parts thereof include components intended for that specified product or equipment categories. Foams in equipment shall be reported here. Imports of pre-blended polyols (e.g. in polyurethane systems) shall not be reported in 11_H4 here, but in Section 2.
