Article 1

Implementing Regulation (EU) 2019/1014 is amended as follows:

(1)

Article 3 is amended as follows:

(a)

the following paragraph 3a is added:

‘3a.   The drainage referred to in paragraphs 2 and 3 shall be suitable for eliminating any risk of contamination and permit housing, storage, cleaning and disinfection under conditions which are appropriate for the categories of animals or goods handled in the areas or rooms referred to in those paragraphs.’

(b)

paragraphs 4, 5 and 6 are replaced by the following:

‘4.   The requirement for the unloading areas to be covered by a roof provided for in paragraph 1, point (a), shall not apply in the following cases:

(a)

non-containerised consignments of aquatic animals and fishery products;

(b)

consignments of animal by-products consisting of wool, bulk processed animal protein, loose manure or guano;

(c)

consignments of high volume bulk goods and used agricultural and forestry machinery referred to in Article 47(1), points (c), (d) and (e), of Regulation (EU) 2017/625.

5.   The facilities referred to in paragraph 1, points (a) and (b), shall not be required for the performance of official controls and other official activities on the following:

(a)

bulk liquids of animal origin and non-animal origin;

(b)

high volume bulk goods of non-animal origin unloaded with the use of special equipment directly to storage facilities.

6.   Member States may exempt border control posts, which have been designated for the categories of plants, plant products, and other objects referred to in Article 47(1), points (c) to (f), of Regulation (EU) 2017/625, from the following requirements:

(a)

to have a supply of hot and cold running water and facilities for washing and drying hands referred to in paragraph 1, point (b); and

(b)

to have rooms with ceilings that are easy to disinfect referred to in paragraph 2.’

(c)

paragraph 11 is replaced by the following:

‘11.   The competent authorities of the border control post may permit, under their control, the use of commercial storage facilities for goods referred to in Article 47(1) of Regulation (EU) 2017/625, provided that those facilities are within the close vicinity of the border control post and are under the competence of the same customs authority.

Such commercial storage facilities may be used to perform identity checks and physical checks on plants, plant products and other objects and on goods of non-animal origin, referred to in Article 47(1), points (c) to (f), of Regulation (EU) 2017/625, provided that these storage facilities comply with the minimum requirements laid down in this Regulation.’

(2)

Article 5 is amended as follows:

(a)

in paragraph 1, point (e) is replaced by the following:

‘(e)

housing areas or housing rooms to detain the categories of animals for which the border control posts have been designated;’;

(b)

the following paragraph 6 is added:

‘6.   Hatching eggs may be inspected at border control posts which have been designated for animals referred to in Article 47(1), point (a), of Regulation (EU) 2017/625.’

(3)

in Article 6, paragraph 5 is replaced by the following:

‘5.   Live fish intended for human consumption, live frogs intended for human consumption, live invertebrates, and fishing baits may be inspected at border control posts which have been designated for the categories of goods referred to in Article 47(1), point (b), of Regulation (EU) 2017/625.’

Annex II is amended as follows:

(a)

in point (a), the introductory phrase is replaced by the following:

‘(a)

For animals referred to in Article 47(1), point (a), of Regulation (EU) 2017/625 or covered by conditions or measures referred to in Article 47(1), point (e) or (f), of Regulation (EU) 2017/625’;

(b)

in point (c), the introductory phrase is replaced by the following:

‘(c)

For plants, plant products and other objects referred to in Article 47(1), point (c), of Regulation (EU) 2017/625 or covered by conditions or measures referred to in Article 47(1), points (d), (e) or (f), of Regulation (EU) 2017/625’;

(c)

in point (d), the introductory phrase is replaced by the following:

‘(d)

For goods of non-animal origin covered by conditions or measures referred to in Article 47(1), points (d), (e) or (f), of Regulation (EU) 2017/625’.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .
