Article 1

The position to be adopted on the Union’s behalf within the EEA Joint Committee concerning the proposed amendment of Annex IV (Energy) to the EEA Agreement shall be based on the draft decision of the EEA Joint Committee attached to this Decision.

Article 1

The following point is inserted after point 55 (Commission Regulation (EU) 2015/703) of Annex IV to the EEA Agreement: ‘56. 32017 R 0459 : Commission Regulation (EU) 2017/459 of 16 March 2017 establishing a network code on capacity allocation mechanisms in gas transmission systems and repealing Regulation (EU) No 984/2013 ( OJ L 72, 17.3.2017, p. 1 ). The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation: Norway may suspend the implementation of the Regulation until a gas transmission network starts operating on its territory. Norway shall notify the EFTA Surveillance Authority when a gas network is in place. The Regulation shall not apply to Iceland or Liechtenstein.’.

Article 2

This Decision shall enter into force on the date of its adoption.

Article 2

The text of Commission Regulation (EU) 2017/459 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union , shall be authentic.

Article 3

This Decision shall enter into force on …, provided that all the notifications under Article 103(1) of the EEA Agreement have been made  ( *1 ) .

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union .
