Non-compliance

Article 40

1. Member States shall take appropriate legal or administrative measures in case of non-compliance with this Regulation. 2. Member States shall put in place effective provisions against the use of the EMAS logo in violation of this Regulation. Provisions put in place in accordance with Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005 concerning unfair business-to-consumer commercial practices in the internal market ( 12 ) may be used.
