Launch of a general investigation under Article 11 of the SSM Regulation
Article 142
The ECB shall conduct an investigation of any legal or natural person referred to in Article 10(1) of the SSM Regulation on the basis of an ECB decision. Such decision shall specify all of the following: (a) the legal basis for the decision and its purpose; (b) the intention to exercise the powers laid down in Article 11(1) of the SSM Regulation; (c) the fact that any obstruction of the investigation by the person being investigated constitutes a breach of an ECB decision within the meaning of Article 18(7) of the SSM Regulation, without prejudice to national law as laid down in Article 11(2) of the SSM Regulation.
