ANNEX IV Verification procedure for market surveillance purposes When performing the market surveillance checks referred to in Article 3(2) of Directive 2009/125/EC, the authorities of the Member States shall apply the following verification procedure for the requirements set out in Annex II: 1. The Member State authorities shall test one single unit per model. The unit shall be tested with one or more fuels with similar characteristics as the fuel(s) that were used by the manufacturer to perform measurements according to Annex III. 2. The model shall be considered to comply with the applicable requirements set out in Annex II to this Regulation if: (a) the declared values comply with the requirements set out in Annex II; (b) the seasonal space heating energy efficiency η s is not more than 5 % lower than the declared value; (c) the emissions of: (1) particulate matter (PM) shall not exceed the declared value by more than 20 mg/m 3 at 13 % O 2 for open fronted solid fuel local space heaters, closed fronted solid fuel local space heaters using solid fuel other than compressed wood in the form of pellets and cookers and 10 mg/m 3 at 13 % O 2 for closed fronted solid fuel local space heaters using compressed wood in the form of pellets when measured according to the method described in Annex III, point 4(a)(i)(1) or by more than 1 g/kg when measured according to the method described in Annex III, point 4(a)(i)(2) or by more than 0,8 g/kg when measured according to the method described in Annex III, point 4(a)(i)(3); (2) organic gaseous compounds (OGCs) shall not exceed the declared value by more than 25 mgC/m 3 at 13 % O 2 for open fronted solid fuel local space heaters, closed fronted solid fuel local space heaters using solid fuel other than compressed wood in the form of pellets and cookers and 15 mgC/m 3 at 13 % O 2 for closed fronted solid fuel local space heaters using compressed wood in the form of pellets; (3) carbon monoxide (CO) shall not exceed the declared value by more than 275 mg/m 3 at 13 % O 2 for open fronted solid fuel local space heaters, closed fronted solid fuel local space heaters using solid fuel other than compressed wood in the form of pellets and cookers and 60 mg/m 3 at 13 % O 2 for closed fronted solid fuel local space heaters using compressed wood in the form of pellets; (4) nitrogen oxides (NO x ) shall not exceed the declared value by more than 30 mg/m 3 expressed as NO 2 at 13 % O 2 . 3. If the result referred to in point 2(a) is not achieved, the model and all equivalent models shall be considered not to comply with this Regulation. If any of the results referred to in points 2(b) or 2(c) is not achieved, the Member State authorities shall randomly select three additional units of the same model for testing. As alternative, the three additional units selected may be of one or more equivalent models which have been listed as equivalent product in the manufacturer's technical documentation. 4. The model shall be considered to comply with the applicable requirements set out in Annex II to this Regulation if: (a) the declared values for the three additional units comply with the requirements set out in Annex II; (b) the average seasonal space heating energy efficiency η s of the three additional units is not more than 5 % lower than the declared value; (c) the average emissions of the three additional units: (1) particulate matter (PM) shall not exceed the declared value by more than 20 mg/m 3 at 13 % O 2 for open fronted solid fuel local space heaters, closed fronted solid fuel local space heaters using solid fuel other than compressed wood in the form of pellets and cookers and 10 mg/m 3 at 13 % O 2 for closed fronted solid fuel local space heaters using compressed wood in the form of pellets when measured according to the method described in Annex III, point 4(a)(i)(1) and by more than 1 g/kg when measured according to the method described in Annex III, point 4(a)(i)(2) or by more than 0,8 g/kg when measured according to the method described in Annex III, point 4(a)(i)(3); (2) organic gaseous compounds (OGCs) shall not exceed the declared value by more than 25 mgC/m 3 at 13 % O 2 for open fronted solid fuel local space heaters, closed fronted solid fuel local space heaters using solid fuel other than compressed wood in the form of pellets and cookers and 15 mgC/m 3 at 13 % O 2 for closed fronted solid fuel local space heaters using compressed wood in the form of pellets; (3) carbon monoxide (CO) shall not exceed the declared value by more than 275 mg/m 3 at 13 % O 2 for open fronted solid fuel local space heaters, closed fronted solid fuel local space heaters using solid fuel other than compressed wood in the form of pellets and cookers and 60 mg/m 3 at 13 % O 2 for closed fronted solid fuel local space heaters using compressed wood in the form of pellets; (4) nitrogen oxides (NO x ) shall not exceed the declared value by more than 30 mg/m 3 expressed as NO 2 at 13 % O 2 . 5. If the results referred to in point 4 are not achieved, the model and all equivalent models shall be considered not to comply with this Regulation. The Member State authorities shall provide the test results and other relevant information to the authorities of the other Member States and to the Commission within one month of the decision being taken on the non-compliance of the model. 6. Member State authorities shall use the measurement and calculation methods set out in Annex III. The verification tolerances defined in this Annex relate only to the verification of the measured parameters by Member State authorities and shall not be used by the supplier as an allowed tolerance to establish the values in the technical documentation.
