Availability of electronic systems

Article 5

1.   The Commission and the Member States shall conclude operational agreements laying down the practical requirements for the availability and performance of the electronic systems as well as for business continuity. 2.   Operational agreements referred to in paragraph 1 shall in particular lay down appropriate response time for the exchange and processing of information in the relevant electronic systems. 3.   The electronic systems shall be kept permanently available. However, that obligation shall not apply: (a) in specific cases related to the use of the electronic systems laid down in the agreements referred to in paragraph 1 or, at national level, in the absence of those agreements; (b) in the case of force majeure .
