Article 10
1. Each competent authority authorised to access the EES shall ensure that the use of the EES is necessary, appropriate and proportionate. 2. Each competent authority shall ensure that the use of the EES, including the capturing of biometric data, is in accordance with the safeguards laid down in the Convention for the Protection of Human Rights and Fundamental Freedoms, in the Charter of Fundamental Rights of the European Union and in the United Nations Convention on the Rights of the Child. In particular, when capturing a child’s data, the best interests of the child shall be a primary consideration.
