Change in the composition of a Board
Article 38
1. Where, after oral proceedings, the composition of a Board of Appeal is changed pursuant to Article 43(2) and (3), all parties to the proceedings shall be informed that, at the request of any party, fresh oral proceedings shall be held before the Board of Appeal in its new composition. Fresh oral proceedings shall also be held if the new member so requests and provided that the other members of the Board of Appeal have given their agreement. 2. The new member of a Board of Appeal shall be bound to the same extent as the other members by any interim decision which has already been taken.
