Article 2
1. The transfer of annual losses of DB Cargo AG to Deutsche Bahn AG for the period between 1 January 2022 and 31 December 2024, under the profit and loss transfer agreement between Deutsche Bahn AG and DB Cargo AG concluded on 25 October 2012, as prolonged, constitutes State aid within the meaning of Article 107(1) TFEU. The aid was provided in breach of Article 108(3) TFEU. 2. The aid referred to in paragraph 1 is compatible with the internal market within the meaning of Article 107(3), point (c), TFEU, subject to the conditions laid down in Article 3 of this Decision and the obligations laid down in Article 4 of this Decision.
