Access to the file and use of documents
Article 5
1. Upon request, ESMA shall grant access to the file to the person subject to the investigation to whom the investigating officer or ESMA has sent a statement of findings. ESMA shall grant such access following the notification of any statement of findings. 2. File documents accessed shall be used by the person referred to in paragraph 1 only for the purposes of judicial or administrative proceedings concerning the application of Regulation (EU) 2023/2631.
