SECTION 1. Section 2 of Presidential Decree No. 1605-A is
hereby amended to read as follows:
"Sec. 2. Any person who violates any of the provisions of
this Decree shall suffer the penalty of prision correccional in its maximum
degree and a fine ranging from P10,000 to P100,000: Provided, That if the
offender is a corporation, firm, partnership or association, the penalty shall
be imposed upon the guilty officer or officers (as the case may be, of the
corporation, firm, partnership or association) and if such officer or officers
are aliens, he or they shall be deported without further proceedings by the
Commission on Immigration and Deportation.
Illegal constructions made in violation of this Decree may be ordered
destroyed or demolished upon orders of the Philippine Tourism Authority, the
Philippine Coast Guard, the Philippine Constabulary, the Integrated National
Police, the Office of the President, the Ministry of Human Settlements or a
Court of competent jurisdiction.
Under no circumstance shall any new construction be made on the water edge.
If constructions have already been made they shall be at a distance of 25 meters
away from the high tide water mark under the trees without felling such
trees.
No permit for the construction of any wharf, marina, hotel, restaurants and
other commercial structures in Puerto Galera shall be issued without prior
approval of the Office of the President upon recommendation of the Philippine
Tourism Authority."
