WHEREAS, the respective charters of all cities include a
Department of Engineering headed by the city engineer as one of the
departments of the city government;
WHEREAS, these charters also provide that city engineers
shall be responsible for undertaking all public works projects financed
by city or local funds;
WHEREAS, Republic Act No. 5185, otherwise known as the
Decentralization Law, authorizes city governments to create the position
of city public works supervisors, notwithstanding the fact that there
is already a City Engineer;
WHEREAS, by virtue of this authority, several city
governments have created the position of city public works supervisors
and assigning to this position all work provided by the city charters to
be undertaken by the city Engineer;
WHEREAS, such a situation resulted in overlapping of
functions, and in some instances the city engineer has been completely
divested of his duties and responsibilities to undertake local projects
as provided in the city charter;
WHEREAS, this situation is not conducive to the best
interests of the public, particularly the city residents.
NOW, THEREFORE, I, FERDINAND E. MARCOS, by virtue of the
powers in me vested by the Constitution, do hereby promulgate this
decree as part of the law of the land:
