SECTION 1. Creation of Barangay Don Albino T. Taruc. - Puroks I, II, III and IV are hereby separated from Barangay Navarro and constituted into a new barangay to be known as Barangay Don Albino T. Taruc in the Municipality of Socorro, Province of Surigao del Norte.

AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY DON ALBINO T. TARUC IN THE MUNICIPALITY OF SOCORRO, PROVINCE OF SURIGAO DEL NORTE
SEC. 2. Territorial Boundaries. - The terrotirial boundaries of Barangay Don Albino T. Taruc shall be identified as follows:
Bounded on the Southwest (SW), Northwest (NW) and Northeast (NE) along lines 31-1 to 16 by Barangay Navarro Case 1, Socorro, Surigao del Norte.
On the East (E) along lines 16 to 31 by the Pacific Ocean.

SEC. 3. Conduct and Supervision of Plebiscite. - The plebiscite conducted and supervised by the Commission on Elections (COMELEC) on August 27, 1995 pursuant to Provincial Ordinance No. 001, Series of 1995 of Sangguniang Panlalawigan of the Province of Surigao del Norte, which ratified the creation of Barangay Don Albino T. Taruc, shall serve as substantial compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".
SEC. 4. Incumbent Barangay Official. - The incumbent barangay officials of Barangay Don Albino T. Taruc shall continue to hold office until such time that their successors have been duly elected and qualified.
SEC. 5. Public Infrastructure and Facilities. - All public infrastructure and facilities for public use existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new barangay.
SEC. 6. Internal Revenue Allotment Shares. - Barangay Don Albino T. Taruc shall be entitled to Internal Revenue Allotment (IRA) shares pursuant to Section 285 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".
SEC. 7. Effectivity. - This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
