Section 1Creation of Barangay Tagukon.

SECTION 1. Creation of Barangay Tagukon. — The sitio of Tagukon is hereby separated from Barangay Camingawan in the City of Kabankalan, Province of Negros Occidental and constituted as a distinct and independent barangay to be known as Barangay Tagukon.

Section 2Territorial Boundaries.

SECTION 2. Territorial Boundaries. — The territorial boundaries of Barangay Tagukon are hereby described as follows:

"Bounded on the North by Barangay Carol-an;

On the Northeast by Negros Oriental;

On the Southeast (SE) by Negros Oriental;

On the Southwest (SW) by Ilog River;

On the Northwest by Banga Creek and Inihi-an Creek; and

On the West (W) by Barangay Camingawan.

Containing an area of One thousand nine hundred three and 1509/10000 (1,903.1509) hectares, more or less.”

Section 3Conduct and Supervision of Plebiscite.

SECTION 3. Conduct and Supervision of Plebiscite. — The plebiscite conducted and supervised by the Commission on Elections (COMELEC) pursuant to Provincial Ordinance No. 93-002, Series of 1993 of Sangguniang Panlalawigan of the Province of Negros Occidental, which ratified the creation of Barangay Tagukon as proclaimed by the Plebiscite Board of Canvassers shall serve as substantial compliance with the plebiscite requirement under Section 10 of the Local Government Code of 1991, as amended.

Section 4Incumbent Barangay Officials.

SECTION 4. Incumbent Barangay Officials. — The incumbent elected barangay officials of Barangay Tagukon shall continue to hold office until such time that their successors have been duly elected and qualified.

Section 5Public Infrastructure and Facilities.

SECTION 5. Public Infrastructure and Facilities. — All public infrastructure and facilities existing therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new Barangay Tagukon.

Section 6Internal Revenue Allotment Shares.

SECTION 6. Internal Revenue Allotment Shares. — Barangay Tagukon shall be entitled to internal revenue allotment (IRA) shares pursuant to Section 285 of the Local Government Code of 1991, as amended.

Section 7Effectivity.

SECTION 7. Effectivity. — This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
