AN ACT GRANTING THE DAGUPAN ELECTRIC CORPORATION A PERMIT TO CONSTRUCT, ESTABLISH, AND OPERATE A PRIVATE FIXED LAND-BASED TO LAND-MOBILE RADIO STATIONS FOR THE RECEPTION AND TRANS­MISSION OF RADIO COMMUNICATIONS IN DAGUPAN CITY.

Section 1

SECTION 1. There is hereby granted to Dagupan Electric Corporation a permit to construct, maintain, and operate subject to the approval of the Secretary of Public Works and Communications, a private fixed land-based to land mobile radio stations in Dagupan City for the reception and transmission of wireless messages on radiotelephony each to be provided with radio transmitting apparatus and radio receiving apparatus.

Section 2

SEC. 2. This permit shall continue to be in force for a period of twenty-five years from its approval by the President of the Philippines and is granted upon the express condition that same shall be void unless the construction of said stations be begun within one year from the date of said approval by the President and be completed within two years from said date.

Section 3

SEC. 3. The grantee shall not engage in domestic business of telecommunications, it being understood that the purpose of this permit is to secure to the grantee the right to construct, establish, maintain and operate said radio facilities as the interest of the corporation and its trade and business may justify.

Section 4

SEC. 4. This permit shall not take effect until the Secretary of Public Works and Communications shall have allotted to the grantee the frequencies and wave lengths to be used thereunder, but the grantee may use the international distress frequency of five hundred kilocycles and the high distress frequency of eight thousand two hundred eighty kilocycles whenever necessary.

Section 5

SEC. 5. No fees are chargeable as the radio stations that may be established by virtue of this Act shall engage in communication regarding the grantee's business only.

Section 6

SEC. 6. The grantee shall so construct and operate radio stations as not to interfere with the operation other radio stations maintained and operated in the Philippines.

Section 7

SEC. 7. The grantee shall hold the national, provincial city and municipal governments of the Philippines harmless from all claims, accounts, demands or actions arising out of accidents or injuries whether to property or to caused by the construction or operations of the stations for reception and transmission of wireless messages by the corporation.

Section 8

SEC. 8. The grantee shall not lease, transfer, grant the usufruct of, sell or assign this permit, or the rights or privileges acquired thereunder to any person, natural or juridical, nor merge with any other person, without the previous approval of the Congress of the Philippines. Any person, natural or juridical, to which this permit may be sold, transferred or assigned, shall be subject to the corporation laws of the Philippines now existing or hereafter enacted, and any person to which this permit is sold, transferred or assigned shall be subject to all conditions, terms, restrictions and limitations of this per­mit as fully and completely and to the same extent as if the permit had been originally granted to such persons.

Section 9

SEC. 9. A special right is hereby reserved to the President of the Philippines in time of war, insurrection, public peril, emergency, calamity or disaster to cause the closing of the grantee's radio stations of to authorize the temporary use or possession thereof by any department of the Government upon payment of just compensation.

Section 10

SEC. 10. This permit shall be subject to amendment, alteration or repeal by the Congress of the Philippines when the public interest so requires, and shall not be interpreted as an exclusive grant of the privilege herein provided for.

Section 11

SEC. 11. This Act shall take effect upon its approval.
