AN ACT CONVERTING THE PASACAO SCHOOL OF FISHERIES IN THE MUNICIPALITY OF PASACAO, PROVINCE OF CAMARINES SUR, INTO THE CAMARINES SUR INSTITUTE OF FISHERIES AND MARINE SCIENCES, AND APPROPRIATING FUNDS THEREFOR

Section 1

SECTION 1. The Pasacao School of Fisheries located in the Municipality of Pasacao, Province of Camarines Sur, is hereby converted into the Camarines Sur Institute of Fisheries and Marine Sciences, herein referred to as the Institute.

Section 2

SEC. 2. The Institute shall primarily provide higher technological, professional and technical-vocational training in fisheries and related marine sciences consistent with the goals for local, regional and national development. It shall also promote research and development in the various disciplines and areas of specialization. The Institute shall offer undergraduate courses in the field of fisheries and marine sciences and such other courses as may be necessary to meet provincial, regional and national needs for technically trained manpower.

Section 3

SEC. 3. No student shall be denied admission to the Institute by reasons of sex, ethnic consideration and religious belief or affiliation.

Section 4

SEC. 4. The Institute shall be tinder the direct supervision of the Commission on Higher Education and shall be headed by a vocational school superintendent.

Section 5

SEC. 5. The vocational school superintendent shall have the following duties and responsibilities:

To recommend appropriations to the Commission on Higher Education through the regional office for the operation and maintenance of the Institute;

To recommend the confirmation of titles or degrees in the fields of study stated in Section 2 of this Act to successful candidates for graduation;

To recommend confirmation of certificates and diplomas to successful candidates for graduation on courses other than degree courses;

To recommend appointments submitted by the screening committee to the regional office;

To recommend the curricula and rules of discipline drawn by the department heads and supervisors;

To provide scholarships to faculty and staff showing special evidence of merit; and

To receive in trust legacies, gifts and donations of real and permanent property of all kinds and to administer the same for the benefit of the Institute or of the departments, or for aid to any student or students in accordance with the direction and instruction of the donor or in such other manner as the superintendent may determine, subject to budgeting, accounting and auditing laws, rules and regulations.

Section 6

SEC. 6. The faculty of Pasacao School of Fisheries as well as other personnel shall be absorbed by the new Institute. In order not to disrupt the operation of the institution and to insure the smooth transition from school of fisheries to institute of fisheries and marine sciences, the incumbent vocational school administrator shall serve as the first vocational school superintendent until the expiration of the tenure of his office.

Section 7

SEC. 7. The body of teachers, instructors, master teachers and heads of departments shall constitute the faculty of the Institute.

Section 8

SEC. 8. The faculty and other personnel of the Institute shall be covered by the Civil Service laws, rules and regulations.

Section 9

SEC. 9. All the personnel, records, assets and properties including buildings, sites, and the improvements thereof, obligations, funds and appropriations of the Pasacao School of Fisheries are hereby transferred to the Camarines Sur Institute of Fisheries and Marine Sciences.

Section 10

SEC. 10. The amount needed for the implementation of this Act shall be provided in the General Appropriations Act of the year following its enactment: Provided, That the new name Camarines Sur Institute of Fisheries and Marine Sciences shall take effect upon the approval of this Act. Thereafter, such sums as may be necessary for the continued operation and maintenance of the Institute shall be included in subsequent General Appropriations Acts.

Fees and charges including government subsidies and other income generated by the Institute shall constitute special trust funds and shall be deposited in any authorized government depository bank, and all interests that shall accrue therefrom shall form part of the same funds for the use of the Institute.

The income generated by the Institute may, at the discretion of the Institute, be disbursed for the professional growth and development, health, welfare, and other similar benefits of the faculty members and personnel for extension and student welfare expenses so that the flexibility on use of income shall be focused on faculty, personnel improvement and student welfare activities, and for expenses necessary for the attainment of its purposes under this Act.

Section 11

SEC. 11. This Act shall take effect upon its approval.
